PriceCheck (Pty) Ltd, registration number 2007/013797/07 ("PriceCheck", "we", "us"), respects your right to privacy and is committed to protecting the personal information of all individuals who interact with Brand Insights ("the Service").

This Privacy Policy explains how we collect, use, store, and protect personal information in connection with the Service, and describes your rights under the Protection of Personal Information Act, 4 of 2013 ("POPIA").

By using the Service, you agree to the practices described in this Privacy Policy. If you do not agree, please do not use the Service.

1. Who This Policy Applies To

This policy applies to:

  • Individuals who register for and use Brand Insights on behalf of a company or brand
  • Any additional users added to a company account on the Platform

Brand Insights is a business-to-business platform. We do not knowingly collect personal information from individual consumers for the purpose of this Service.

2. What Personal Information We Collect

When you create and use an account on Brand Insights, we may collect:

  • Account information: Your name, work email address, company name, job title, and contact number
  • Billing information: Payment method details (processed securely by our payment provider; PriceCheck does not store full card details), billing address, and VAT number if applicable
  • Usage data: How you interact with the Platform, features used, pages viewed, session duration, and actions taken within your account
  • Device and technical data: IP address, browser type, operating system, and device identifiers
  • Communications: Any correspondence you send to us, including support requests and emails

3. How We Use Your Personal Information

We use the personal information we collect to:

  • Create and manage your account and provide you with access to the Service
  • Process subscription payments and manage billing
  • Send transactional communications, including invoices, payment confirmations, and account notifications
  • Send product update emails, feature announcements, and service-related communications (you may opt out of non-essential communications at any time)
  • Provide customer support and respond to your enquiries
  • Monitor and improve the performance, security, and functionality of the Platform
  • Comply with our legal obligations under applicable South African law
  • Prevent fraud, abuse, and unauthorised access to the Service

4. Legal Basis for Processing

We process your personal information on the following bases:

  • Contractual necessity: Processing required to provide the Service under the agreement between you and PriceCheck
  • Legitimate interests: For product improvement, fraud prevention, and security purposes
  • Legal obligation: Where required by South African law, including POPIA and the Electronic Communications and Transactions Act
  • Consent: Where you have given us specific consent, such as for marketing communications

5. Sharing of Personal Information

We do not sell your personal information. We may share your information with third parties only in the following circumstances:

  • Service providers: Trusted third-party vendors who assist us in operating the Platform, including cloud infrastructure providers, payment processors, and email delivery services. These parties are bound by confidentiality obligations and may only use your information to provide services to PriceCheck.
  • Legal requirements: Where disclosure is required by law, court order, or regulatory authority.
  • Business transfers: In connection with a merger, acquisition, or sale of assets, provided the receiving party agrees to protect your information in accordance with this policy.
  • Protection of rights: Where disclosure is necessary to protect the rights, property, or safety of PriceCheck, its clients, or the public.

We will not share your personal information with third parties for marketing purposes without your explicit consent.

6. Data Retention

We retain your personal information for as long as your account is active or as needed to provide the Service. Following the termination of your account:

  • Account and usage data is retained for 30 days and then deleted, unless we are required by law to retain it for longer
  • Billing records and transaction history are retained for 5 years in accordance with South African financial record-keeping requirements
  • Communications and support records are retained for 2 years

7. Data Security

PriceCheck implements appropriate technical and organisational measures to protect your personal information against unauthorised access, loss, alteration, or destruction. These measures include:

  • Encryption of data in transit using TLS/HTTPS
  • Secure, access-controlled server infrastructure
  • Role-based access controls limiting internal access to personal data
  • Regular security assessments

While we take reasonable precautions, no system is completely secure. You are responsible for maintaining the confidentiality of your login credentials and for restricting access to your account.

8. Cookies and Tracking

The Platform uses cookies and similar tracking technologies to:

  • Maintain your session and authentication state
  • Remember your preferences and settings
  • Analyse usage patterns and improve the Service

You can control cookie behaviour through your browser settings, however disabling certain cookies may affect the functionality of the Platform.

9. Your Rights Under POPIA

As a data subject under POPIA, you have the right to:

  • Access: Request a copy of the personal information we hold about you
  • Correction: Request that we correct inaccurate or incomplete personal information
  • Deletion: Request the deletion of your personal information, subject to our legal retention obligations
  • Objection: Object to the processing of your personal information in certain circumstances
  • Withdrawal of consent: Where processing is based on consent, withdraw that consent at any time (without affecting the lawfulness of prior processing)
  • Complaint: Lodge a complaint with the Information Regulator of South Africa if you believe your rights have been infringed

Some of our service providers operate outside South Africa. Where personal information is transferred to a country that does not offer a comparable level of data protection, we ensure appropriate safeguards are in place, such as contractual data protection clauses, before any transfer takes place.

We may update this Privacy Policy from time to time. We will notify you of material changes by email or by notice within the Platform. Your continued use of the Service after the effective date of any update constitutes your acceptance of the revised policy.
